General Terms and Conditions of Sale

1. Scope and Agreement
These General Terms and Conditions of Sale (“Terms”) govern the contractual relationship between ROS & CO (trading as RASPIAUDIO), having its registered office at 25 Rue Lenine, 94200 Ivry-sur-Seine, France (“We” or “Seller”), and any individual or legal entity (“You” or “Customer”) making a purchase on raspiaudio.com.
By placing an order, you acknowledge that you have read, understood, and accepted these Terms without reservation.
2. Products and Availability
2.1 Product Description
We describe our audio hardware and accessories as accurately as possible. Photographs are illustrative and do not constitute a contractual binding document.
2.2 Stock and Logistics
We operate a distributed logistics network to optimize delivery times:
European Union Orders: Shipped from our logistics centers in France, Germany, Spain, or Italy.
USA Orders: Shipped primarily from our USA logistics center. If an item is out of stock in the USA, it will be shipped directly from our French headquarters.
Rest of the World: Shipped from our French headquarters.
Offers are valid while visible on the site and within the limits of available stock. In the event of a stockout after an order is placed, we will notify you immediately to offer a refund or a later delivery date.
3. Pricing and Taxes
Prices are displayed in Euros (€) or US Dollars ($).
European Union Customers: Prices include French VAT (20%) or the applicable VAT rate of your country of residence (OSS scheme).
USA Customers: Prices generally exclude Sales Tax. Sales Tax may be calculated and added at checkout depending on the delivery state. If not collected at checkout, the Customer is responsible for reporting and paying any applicable Use Tax in their state.
International Customers (Non-EU): Products are sold DAP (Delivered At Place) / DDU (Delivered Duty Unpaid). You are the importer of record. You are responsible for paying all import duties, customs fees, and local taxes levied by your country upon arrival.
4. Payment
Payment is due immediately upon order confirmation. We accept major credit cards (Visa, MasterCard, Amex) and PayPal. All transactions are encrypted and secured by our payment processors. ROS & CO does not store your full banking details.
5. Shipping and Delivery
5.1 Estimated Delivery Times
Delivery times are estimates and include processing time plus carrier transit time:
European Union: 3 to 5 business days.
USA: 3 to 5 business days (if shipped from US stock); 7 to 10 business days (if shipped from France).
Rest of World: 10 to 20 business days.
5.2 Liability
ROS & CO is not liable for delays caused by customs clearance processes or carrier service disruptions.
6. Right of Withdrawal (Returns)
In compliance with the EU Consumer Rights Directive and French Law (Article L.221-18), you have 14 days from the receipt of your order to exercise your right of withdrawal without providing a reason.
6.1 Return Conditions
Items must be returned in their original, unopened condition with all accessories and packaging.
Exclusions: We cannot accept returns for electronic components that have been soldered, modified, or used in a way that makes resale impossible.
6.2 Return Procedure & Costs
Notification: You must notify us of your intent to return via email at info@raspiaudio.com.
Return Address: Regardless of your location (USA, EU, or elsewhere), all returns must be shipped to our headquarters: ROS & CO 25 RUE LENINE 94200 IVRY-SUR-SEINE FRANCE
Shipping Costs: The Customer is responsible for all return shipping costs. We recommend using a trackable shipping service.
7. Legal Warranty
7.1 Statutory Guarantees (EU Customers)
You benefit from the legal guarantee of conformity (Articles L.217-3 et seq. of the Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the Civil Code) for a period of two (2) years.
7.2 Warranty Exclusions
This warranty covers manufacturing defects. It does not cover damage resulting from:
Negligence, misuse, or accidents (e.g., dropping the device).
Improper wiring, over-voltage, or electrostatic discharge (ESD).
Modifications, soldering errors, or DIY repairs attempted by the Customer.
8. Limitation of Liability
Our products are intended for educational and hobbyist use (DIY). ROS & CO shall not be liable for any direct or indirect damage caused to third-party equipment (such as Raspberry Pi boards, speakers, or computers) resulting from the assembly or use of our products.
9. Personal Data
We collect necessary personal data (name, address, email) solely to process your order. In accordance with the GDPR, you have the right to access, rectify, or delete your data by contacting info@raspiaudio.com.
10. Applicable Law and Disputes
These Terms are governed by French Law. In the event of a dispute, we encourage you to contact us first to seek an amicable solution.
Consumer Mediation: In accordance with Article L. 612-1 of the Consumer Code, you may use the FEVAD (Fédération du e-commerce et de la vente à distance) mediation service for any unsettled consumer dispute.
If no amicable solution is found, the courts of France shall have exclusive jurisdiction.
